USFDA Issues Warning Letter About ENDS Products

After reviewing the website https://www.ecigaretteempire.com and discovered that electronic nicotine delivery system (ENDS) products listed there are offered for sale or distribution to customers in the United States , United States Food and Drug Administration(USFDA) issues a warning letter to E-cigarette Empire LLC informing that ENDS products they are offering, are tobacco products because they are made or derived from tobacco and intended for human consumption and does not comply with the requirements in the Federal Food, Drug, and Cosmetic Act (FD&C Act).

According to USFDA, the following product; Kilo 1K Replacement Pods; Strawberry Milk and Drip Fried Cream Cakes E Juice by Fryd offered by E-cigarette Empire LLC are new and does not have a market authorization as it is required by the FD&C Act. Furthermore, these products are misbranded and adulterated under the FD&C Act. Particularly,Drip Fried Cream Cakes E Juice by Fry appears to imitate a food product that is typically marketed toward and/or appealing to children. Therefore, FDA consider the action of E-cigarette Empire LLC likely encourage unlawful sales, maintain or increase youth use, and contribute to the public health and safety concerns associated with ENDS products.

Finally, E-cigarette Empire LLC advised to correct these violation, and take any necessary actions to bring these tobacco products into compliance with the FD&C Act. They are also asked to submit a written response to this letter within 15 working days from the date of receipt describing their corrective actions
